Terms of Service

1. The service

Data First (datafirst.reinaldofigueroa.com) lets you build, preview, purchase, export, and deliver marketing contact lists assembled from licensed third-party data. By creating an account or using the platform you agree to these terms.

2. Your account

Keep your credentials confidential; you are responsible for activity under your account. Provide accurate information, including a real, monitored email address.

3. Purchases and refunds

List purchases are one-time payments processed by Stripe, priced per record as shown at checkout. Purchased lists include the coverage measured and displayed on the checkout page. If delivered coverage falls short of what was shown, we refund the difference or replace the shortfall — the coverage guarantee shown at checkout.

4. Acceptable use of purchased data

You agree to use purchased lists lawfully, including:

• complying with applicable marketing laws (including CAN-SPAM, TCPA, and state privacy laws) for the channels you use;
• honoring the Do-Not-Call flags and suppression signals included in the data;
• not reselling, sublicensing, or redistributing the data as a data product;
• not using the data to harass, discriminate, or harm the people in it.

You are the data controller for how you contact records after delivery.

5. Connected platforms

When you connect a third-party platform (such as Google Ads or a CRM), you authorize Data First to use the stored credentials solely to deliver lists you choose into your own account on that platform. Your use of those platforms remains governed by their terms. You can disconnect at any time.

6. What we promise, and what we don't

We label measured versus estimated attributes and publish how our data is sourced. Marketing data is inherently imperfect; apart from the coverage guarantee above, the service is provided "as is" without warranties, and our total liability for any claim is capped at the amount you paid us in the twelve months before the claim.

7. Your data

Lists you purchase are yours. You can export your data at any time; we do not hold it hostage. Our handling of personal data is described in the Privacy Policy.

8. Termination

You can close your account at any time. We may suspend or terminate accounts that violate these terms or misuse the data. On termination you keep lists already delivered, subject to Section 4.
